Acceptable Use Policy: InterNet Access Network ("IAN") provides uncensored, unmetered usage to the Internet. Users must not abuse the "unmetered" aspect of our service. "Unmetered Usage" means that you will not be charged any hourly fees. Your computer may remain connected to the Internet via IAN's dial-up modems as long as its keyboard and/or mouse are operated at all times by a human operator. Unmetered usage does not mean you may leave your computer continuously connected to the Internet. Usage in excess of 320 hours per month/ per user is considered abusive usage of the system. User also agrees to pay a fee of $1.00 per hour in excess of 320 hours per month. It is an illegal use of the system to automate any software to enable your connection to remain active when a human being is not actually using the computer. You will be temporarily disconnected after 20 minutes of inactivity. You may not configure your computer so as to permit any other computer to access your computer while your computer is connected to IAN. You may not resell or transfer your access to others. Users who attempt to violate these restrictions will be immediately disconnected and their account will be terminated, with no refund of subscription fees. If you are currently a member and these terms of Acceptable Use are not acceptable to you, please notify our office to terminate your account.
You must be at least 18 years of age to qualify for membership in IAN. There can be no exceptions to this age requirement. Parents are fully responsible for the use of our network by minor children.
Service: IAN reserves the right to refuse service to anyone for any reason and to terminate service to any existing account at our discretion. Service will commence upon the date that your application and payment for the setup fee and first month's service are received. This date is the "Commencement Date". THE INTERNET Internet Access Network SERVICE IS PROVIDED ON AN "AS-IS, AS AVAILABLE" BASIS. NO WARRANTEES, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THOSE OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE MADE WITH RESPECT TO INTERNET ACCESS NETWORK OR ANY INFORMATION OR SOFTWARE THEREIN. THIS NO WARRANTY EXPRESSLY INCLUDES ANY REIMBURSEMENT FOR LOSSES OF INCOME DUE TO DISRUPTION OF SERVICE BY INTERNET ACCESS NETWORK OR ITS PROVIDERS. Neither Internet Access Network nor its Information Providers are responsible for any damages arising from User's use of Internet Access Network or by User's inability to use Internet Access Network's service, including, but not limited to, email, World Wide Web and File Transfer protocol services. IAN will make access available to you on a best effort basis. Service outages can occur over which we have no control. In the event an outage lasts more than 24 hours, we will at your request, prorate the applicable portion of your monthly service charge.
Support: InterNet Access Network is only responsible for supporting issues directly related to connecting via modem to our service, and connecting to the internet via the software provided with our sign-up, and only that software. InterNet Access Network will not be responsible for modem communications problems , modem support, modem installation or modem failure. In addition, InterNet Access Network will not be responsible for new software installation, new software configuration, or new software failure if the software is not provided and endorsed by InterNet Access Network.
Acceptable Use: IAN reserves the right to suspend or terminate service to you if your actions threaten the integrity or continued operation of our network or in IAN's sole discretion, your actions or behavior on the Internet are deemed unacceptable. No adult materials may be stored or placed on our internal network such as, but not limited to, personal or commercial www webspace provided by IAN for the use of it's customers. Any activities which involve any aspect of child pornography will be documented and referred to the proper authorities for prosecution under applicable statutes of the law. Any request for information regarding the location or other specifics of any registered IAN user, by any authorized legal or law enforcement agency will be honored with due haste. IAN does not monitor the activity of any of it's users and does not intend to.
IAN reserves the right to suspend or terminate service to you if your actions threaten the integrity or continued operation of our network or in IAN's sole discretion, your actions or behavior on the Internet are deemed unacceptable. IAN explicitely prohibits and bans the practice of SPAMMING (distribution of Unsolicited Bulk Email or Unsolicited Commercial Email). Any user who distributes SPAM will be terminated immediately with no refund of unused subscription fees and a $250.00 cleanup fee will be assessed, and collected. The Subscriber agrees to pay all necessary collection charges and fees.
Payment for Service: Payments for service is due by the due date, (which is the Commencement Date), of each month, paid in advance. On the due date of the month, accounts not brought up to date will be disabled until payment is received. Cancellations received less than 15 days before the due date will take effect after the last day of the current accounting cycle. Delinquent accounts will be charged 1 1/2 percent per month, any checks and/or drafts returned to IAN will be charged an additional $25. Customer agrees to pay all collection fees incurred on delinquent accounts. A $5.00 re-connection fee will be required with the payment for the current month before the account is re-activated. All payments are final and no refunds for unused time will be honored.
IAN reserves the right to submit credit card authorization requests, direct debit requests and bank drafts as many times as is necessary to collect all fees due to IAN, regardless of the financial consequences to the subscriber, including but not limited to any fees and or charges collected from the subscriber by any such financial institution.
All changes to billing procedures for an account must be received no later than 15 days before the billing date for that account. If changes to billing procedures are received less than 15 days before the billing date for an account, IAN will endeavor to make the changes as swiftly as possible but cannot warrant that said changes will be completely effective by the current billing date. IAN can in no way be held responsible for bank, credit card company or other fees and or charges the subscriber may incur due to requested billing procedure changes received less than 15 days before the account due date.
Service Levels: IAN offers several levels of service which are differentiated by features and price. Any account owner may "Upgrade" to a level of service which has a higher subscription fee at no cost for the upgrade. Any account owner who "Downgrades" to a level of service which has a lower subscription fee will be charged a $25.00 downgrade fee.
Pre-payment of Services: Services which are ordered and pre-paid for any period of time exceeding one (1) month and the price of which has been discounted due to this pre-payment are subject to an early cancellation fee of 50% of undiscounted fees applied to services to the date of early cancellation or the remainder of the pre-paid fees, whichever is greater. Early cancellation requests received 15 days prior to the monthly anniversary date of the account will be cancelled prior to the next monthly billing cycle. If early cancellation request is received later than 15 days prior to the next monthly anniversary date, the cancellation will commence with the beginning of the billing cycle following the next billing cycle.
Any pre-paid fees for any non-discounted services are final and do not qualify for any refund.
By accepting membership, you are consenting to be bound by the above agreement and you avow that you are at least 18 years of age. Usage or continued usage of your account rights also constitutes acceptance of the Terms and Conditions stated above. If you are currently a Member of IAN and choose not to accept and abide by the above Terms and Conditions, please notify us to terminate your account.
IAN reserves the right to update and/or modify this agreement at any time, without prior notice.
